Former NYS Traffic Court Judge

Between 1989 to 1993 Mr Dee served as Administrative Law Judge for the New York State Department of Motor Vehicles (Bronx and Harlem Traffic) and so knows the law from both sides of the bench.


Harold Dee, a former NY Traffic Court Judge, decided twenty five thousand (25,000) traffic court hearings while a sitting Administrative Law Judge in the Bronx and Manhattan traffic courts. He has been practicing law in the State of New York for thirty four years, the last eighteen of them while based in Westchester County. Former Judge Dee generally represents individuals and trucking companies charged with violations of the NYS Vehicle and Traffic Law in Westchester County, and also in New York City, Rockland, Columbia, Orange, Putnam and Dutchess, and on Long Island in the counties of Nassau and Suffolk.

Continuing Education: Drunk Driving Defense (DWI) is a complex area of the law, and is continually changing. Within the last 20 years the BAC (Blood Alcohol Content) needed to charge an individual with a crime has dropped from a .15 to almost one-half of that, a .08. Continuing education is an integral part of the mastery of the science involved, namely breath testing. Mr. Dee completes an average of 25 hours of continuing legal and scientific education annually. He is a member of the New York State Association of Criminal Defense Lawyers and is a consultant to Judges and other attorneys in matters of DMV enforcement in the State of New York. His expertise, gained through the representation of thousands of individuals charged with various traffic, alcohol and/or drug violations in New York State prompted Court TV to invite former Judge Dee as a guest speaker for the defense.

Mr. Dee represents clients charged with various alcohol and/or drug impaired operation such as DWI, DWAI, and/or DUI. The firm has represented motorists charged at roadblocks, some while asleep in parked cars, others who simply sought shelter in a heated vehicle, and a myriad of circumstances. Some of our DWI clients gave urine, others blood, but most gave breath samples. Each case is different. We have the experience to answer all your questions and to competently represent you. We enlist many experts in fields such as breath testing, field sobriety testing, traffic design and safety , accident reconstruction, toxicology, and pharmacy. Over the last thirty four years, of which eighteen have been while based in Westchester, Mr. Dee has earned the respect of Judges, Court personnel and the various Assistant District Attorneys by conducting his practice with integrity. Prosecutors base a lot of their case on the results of chemical blood or breath alcohol tests. Former Judge Dee has successfully represented defendants with BAC’s of .04 (CDL drivers) to .33.

An attorney, even with Mr. Dee’s knowledge and experience, cannot guarantee an outcome. However, he may be able to predict a particular outcome in a given case, given the fact that he has undoubtedly had a similar fact pattern in the same court, probably before the same Judge.
