TRAFFIC TICKETS
As a practicing Westchester attorney, Mr. Dee knows most of the County's Traffic Court Clerks. We work on a weekly basis with the busiest traffic courts in the County of Westchester. We are in the Bedford Village Court, Greenburgh Town Court, Harrison Town Court, Mount Pleasant Town Court, and theYorktown Town Court, on a weekly basis. We know the Westchester court clerks and Judges and their tolerance levels. Twenty five thousand (25,000) Vehicle & Traffic Hearings in the Bronx and Manhattan Traffic Courts involving common traffic offenses such as speeding, disobeying signs, red lights, uninsured, unregistered, uninspected, following to closely, school bus violations, red lights, and a host of other traffic ticket violations has made him knowledgeable in the NY Vehicle and Traffic Law.
Speeding and DWI are violations of the Vehicle and Traffic Law. DMV, where Mr. Dee worked for four years, is the New York State Department of Motor Vehicles, an integral partner with the Town, Village or City Traffic Court, and you, in the outcome of your speeding ticket or other charge.
SPEEDING TICKETS
Harold Dee knows the penalties and DMV sanctions that await you if you make an uninformed decision regarding a DWI or Speeding or other traffic ticket matter. Mr. Dee has plea bargained thousands of speeding cases in local Village, Town or City Courts here in Westchester County.
Speeding trials involve violations of Vehicle and Traffic Law (VTL) 1180a,(unreasonable speed), VTL 1180b, (greater than 55 mph) VTL 1180c, (School zone), VTL 1180d (requiring posted signage), and VTL 1180e (approaching railroad crossing) and VTL 1180f , a "work zone" speeding ticket. A conviction of VTL 1180f leads to double fines and a second conviction causes license suspension.
Speeding tickets are commonly issued by Troopers on I 684, I 84, I 87 (The Deegan or NYS Thruway), I 95, the Cross Westchester Expressway (I 287), the Sprain Brook and the Taconic Parkway. Three (3) speeding convictions in 18 months leads to a 6 month suspension of your license (or out of state privileges) here in New York State. The Westchester County Police typically write speeding tickets on the Parkways within the County, namely The Hutchinson Parkway, the Bronx River Parkway, the Saw Mill River Parkway and, like the Troopers, wherever else they see a violation.
Harold Dee has represented motorists in most Westchester Town, Village and City Courts and has tried DWI and Speeding cases in half of all Westchester Courts.
Dee has trial experience in the Town of Bedford, Yorktown Town Court, New Castle Town Court, White Plains City Court, Cortlandt Manor Town Court, Peekskill City Court, Ossining Village Court, Ossining Town Court, Tarrytown Village Court, Greenburgh Town Court, Mount Pleasant Town Court, Mt. Vernon City Court, New Rochelle City Court, North Salem Village Court, South Salem Village Court, Pound Ridge Village Court, Briarcliff Manor Village Court, Hastings on Hudson Village Court, Irvington Village Court, Yonkers City Court, Mount Kisco Village Court, Croton on Hudson Village Court and the Somers Town Court.
For some other moving traffic violation you may not need an attorney or an attorney may not be able to do any better than you may be able to do for yourself, assuming there is no defense to the charge, in a particular court with a particular Judge. One caveat to remember is that an attorney can appear on your behalf.
The firm knows the Judges and their proclivities. We will tell you what an offer might be to a particular charge in lieu of trial.. Do you have a clean license heretofore and are fearful of insurance increases? Did you know that not all point bearing traffic convictions cause an insurance increase? Are you from a neighboring State or Ontario, Canada where the violation is not reported by such sister State or Canadian province.

DWI
If you are charged with a DWI in the State of New York it is a Misdemeanor, a crime! If this is the second time you are charged with a DWI within ten years of a conviction for DWI, you are most likely facing a Felony charge. If convicted of any Felony (including multiple DWI convictions) goodbye professional license!
Penalties for DWI include jail and/or probation, loss of driving privileges for up to three (3) years, (life in some instances), mandatory substance abuse counseling, DWI fines of up to $2500.00 plus surcharges, and NYS DMV assessments starting at $750.00. Sanctions also include a prohibition against driving into Canada. An individual convicted of, or even simply charged with, an alcohol related violation within the last ten years (that's how long the conviction stays on your driver abstract) may fly in or train in or be a passenger in a vehicle, but may not drive himself or his vehicle into Canada! After three years from your conviction, a fee of approximately $350.00 may be paid to the Canadian Consulate to lift the prohibition against you. A conviction also brings increased auto, homeowner, umbrella and keyman insurance premiums, if you are not dropped all together! In short, a horror show!

There are many defenses to alcohol related charges. Tell us what happened. Help us to help you! We employ expert witnesses to attack the credibility of blood, breath and urine tests as well as the testing device that reported the "blood alcohol content, and the arresting officer's common law opinion as to your state of sobriety.
THE TRAFFIC VIOLATIONS BUREAU
Non criminal traffic tickets are addressed by the local city, town, or village criminal court in most of New York State.
The New York State DMV Traffic Violations Bureau (or TVB) adjudicates non-criminal moving violations issued in certain jurisdictions, including New York City, Buffalo, Rochester, and the five towns of Western Suffolk County. If you receive a traffic ticket in these areas, your case will be heard at an administrative hearing rather than in a local criminal court. There are many rules which make it difficult for motorists who contest a TVB traffic ticket or summons. For example, you cannot plea bargain your case, there is no right to discovery, no supporting deposition are available, hearsay evidence is admissible and many rules of evidence do not apply. Additionally, if you are more than one hour late for a scheduled hearing it could result in a suspension of your operating privileges.
We can provide answers, suggestions and defenses to help your speeding or traffic tickets violation. If you plead guilty to a traffic ticket offense such as speeding or disobeying a Traffic Control Device (VTL 1110a) your auto insurance rates will undoubtedly increase. Many times other protective policies such as Homeowner, Keyman and Umbrella Insurance policy premiums also increase. You will also accumulate points on your New York State driver's license which may lead to additional driver responsibility assessment charges (three hundred dollars ($300.00) once your point total reaches six (6) points, and an additional $75.00 for every point charged against you within the same 18 month period). This new assessment program is applicably to any driver incurring six points in NYS regardless of what state they are licensed in.
In addition, if a New York State driver is convicted of three speeding tickets, all issued in NY within the same 18 month period, their New York State license (or out of state driver privileges) will be revoked for a minimum six months. A restricted license may be available to you.
Our goal is to obtain a dismissal or reduction of the charge to one that will have no impact or the least impact on your driver's license (suspension at eleven points) and auto insurance costs. If you have past charges which have not been resolved, our lawyers work with the New York Department of Motor Vehicles, the Traffic Violations Bureau (TVB), and the various local municipalities to clear those tickets and keep your driver's license from being suspended or revoked. We help to restore suspended licenses nationwide!
In addition to DWI defense, the firm defends clients charged with other traffic, speeding and/or criminal offenses, including:
- Driving with suspended or revoked license (AUO)
- Operating a vehicle with a suspended registration
- Out of State Tickets received on a NYS license
